EU Ethics Group Urges Systemic Governance for Neuro-AI Infrastructure

The European Group on Ethics in Science and New Technologies (EGE) is calling for a fundamental shift in how the European Union regulates the convergence of neuroscience and artificial intelligence. In a new statement, the group argues that current regulatory frameworks must evolve to address the systemic risks posed by Neuro-AI.
In the statement titled "Governing Neuro-AI: Towards an Infrastructure Approach," the EGE urges policymakers to move beyond a narrow focus on individual devices and basic data privacy. Instead, the group advocates for the systemic governance of the entire infrastructure—the networks used for the collection, processing, and development of models—that enables the reuse of neurodata. According to the EGE, this approach is necessary to protect fundamental rights as these technologies advance.
The Challenge of Neuro-AI
Neuro-AI represents the intersection of neurotechnology and AI, allowing for the collection and analysis of brain data to build sophisticated AI models. While this convergence promises significant breakthroughs in brain research, rehabilitation, and general healthcare, it introduces unprecedented risks. Specifically, the EGE highlights the danger of exposing highly personal information and the ability of AI to generate sensitive inferences about a person's mental state from brain activity.
Because of these risks, the EGE recommends that EU law provide stronger protections for both raw neurodata and the information inferred from that data. The group also supports the responsible development of "Brain Foundation Models" and the infrastructure required to sustain them, provided they are governed by strict ethical standards.

Traditional data privacy laws may prove insufficient in the face of Neuro-AI because AI can derive sensitive insights that were not explicitly collected by the user or the device. By shifting the focus to infrastructure-level governance, the EGE aims to prevent disproportionate control over individuals and ensure that the development of these technologies remains under democratic accountability.
