The global race to secure intellectual property for generative AI has reached a fever pitch, with filing volumes now dwarfing a decade of previous innovation. According to the World Intellectual Property Organization (WIPO), including its 2026 Technology SPARK Report, the industry is witnessing an unprecedented surge in patent activity that signals a fundamental shift in how AI technology is developed and owned.

Between 2024 and 2025, more than 56,000 new generative AI (GenAI) patent families were published. This two-year window produced more intellectual property than the entire preceding ten years combined. The data highlights a dramatic change in technical dominance: Large Language Models (LLMs) have overtaken Generative Adversarial Networks (GANs) as the primary focus of innovation, outnumbering them by approximately 3 to 1. Geographically, China-based inventors lead the surge by a wide margin, followed by the U.S., Japan, and Korea.

A Shift in Innovation

Historically, AI patenting was a concentrated effort led by a handful of tech giants and centered largely on GANs. However, the rise of LLMs and diffusion models has broadened the scope of the field. WIPO's tracking indicates that patenting is no longer the exclusive domain of pure-play technology firms. Instead, innovation is expanding into diverse sectors including finance, energy, and healthcare as companies move to protect vertically integrated AI strategies tailored to specific industries.

The Rise of the Conglomerates

This diversification is most evident in the emergence of non-traditional tech leaders. SoftBank has surged to become the world's largest GenAI patent holder by volume, publishing nearly 3,000 patent families, the majority of which appeared in 2025. The entry of such diversified conglomerates suggests that the battle for AI supremacy is moving beyond software development and into the control of the underlying infrastructure and broad asset portfolios.

Strategic Implications

This massive influx of filings represents a critical window for strategic positioning. The current "land grab" in patenting is expected to dictate competitive advantages and licensing power within the AI economy for years to come. As the field becomes increasingly crowded, the ability to navigate existing patents will determine which companies can scale their products without facing prohibitive legal hurdles.
