Legislative Gridlock Despite Institutional Backing

The CLARITY Act (H.R. 3633), designed to resolve jurisdictional disputes between the SEC and CFTC over digital asset regulation, has secured endorsements from Goldman Sachs, Fidelity, BlackRock, Charles Schwab, Grayscale, and law enforcement groups including FLEOA. Yet Senate Majority Leader John Thune has expressed doubt that the bill currently has enough votes to pass, though he may schedule a vote to gauge support.

David Solomon, Goldman Sachs CEO, said: "I'm very supportive of moving the Clarity Act forward, so we can get some market structure in place."

The legislation includes an ethics provision agreed to by Donald Trump that would restrict US officials from issuing or sponsoring digital assets, though the exact wording remains unpublished and Democrats have criticized it as insufficient.

BitMEX Exit Follows Fraud Allegations

BitMEX will stop all trading on September 23, having already halted new account registrations on July 23. The shutdown coincides with a class-action lawsuit seeking approximately $40.7 million (622.66 BTC) that alleges the exchange's internal trading team accessed customer private information and manipulated liquidations.

The lawsuit represents a final legal challenge for an exchange that pioneered high-leverage crypto derivatives but struggled under regulatory pressure and declining volumes in recent years. The collapse signals further consolidation in the derivatives market toward a smaller set of dominant players.

The likely failure of the CLARITY Act leaves the US crypto industry in continued regulatory limbo despite sustained institutional lobbying. Simultaneously, BitMEX's exit underscores the legal risks facing early-era exchange practices as the industry matures under heightened scrutiny.
