The Digital Asset Market Clarity Act sits one vote short of becoming law, stalled in the Senate over whether President Donald Trump's billion-dollar crypto fortune requires enforceable ethics restrictions before the bill can advance.

House Republicans passed H.R. 3633 in July 2025 with a 294-134 vote. The Senate Banking Committee approved it 15-9 in May 2026 on a bipartisan basis. But the full Senate has not scheduled a floor vote before the August 2026 recess, with Republicans unable to secure the 60 votes needed to overcome a filibuster.

The Ethics Impasse

Senator Elizabeth Warren is leading Democratic demands for binding provisions that would prevent senior officials from profiting from the crypto industry they regulate. Trump's 2025 financial disclosure revealed approximately $1.4 billion in total crypto-related income, including roughly $635 million in royalties from the TRUMP meme coin venture and an estimated $515 million to $580 million from World Liberty Financial, according to multiple independent reviews of the disclosure.

Trump's personal financial interests have transformed a technical jurisdictional debate into a high-stakes ethics battle. Democrats argue that without enforceable restrictions, the bill's regulatory framework could be shaped to benefit officials' private holdings.

One Yard Line

Coinbase CEO Brian Armstrong told CNBC on July 21 that the legislation is at the "one-yard line" and reported that the president has agreed to an ethics deal. Multiple outlets including CoinTelegraph and Decrypt confirmed Armstrong's statement about the ethics agreement, though the draft text had not been publicly released at the time of reporting.

"The status quo is that we don't have any federal laws protecting consumers or helping this industry get built in the United States," Armstrong said.

The bill would establish a statutory distinction between crypto commodities and crypto securities, assigning clear jurisdictional authority to the CFTC and SEC respectively. This framework has been the industry's top legislative priority for years, as Bitcoin achieved institutional adoption through ETFs while DeFi protocols and altcoins remained in regulatory limbo.

Market Odds Shift

Prediction market traders on Polymarket priced the odds of CLARITY Act passage at approximately 37% in late July 2026, down from earlier expectations, according to CoinDesk and CryptoRank. The decline reflects uncertainty around whether an ethics agreement can be finalized and accepted by Democratic senators before the recess deadline.

Industry advocates warn that continued delay could push major U.S. crypto firms to shift operations offshore, undermining the bill's core objective of retaining innovation and investment within American jurisdiction. Without passage, the patchwork of regulatory interpretations that has governed the sector for years will persist, leaving legal uncertainty for institutional investors and consumer protection gaps unresolved.

Senate leadership has not announced a timeline for bringing the bill to the floor. The August recess deadline looms, with no guarantee that ethics negotiations will conclude in time for a vote before lawmakers depart Washington.
