The CLARITY Act cleared the Senate Banking Committee 15-9 on May 14, 2026, and was placed on the Senate Legislative Calendar on June 1, 2026, making it eligible for floor consideration. A coalition including Coinbase, BlackRock, and the Blockchain Association has pushed for a vote before the August recess, though the bill still faces a 60-vote procedural hurdle amid Democratic concerns over consumer protection.

Prediction markets reflect cautious optimism. Polymarket assigns a 38-39% probability that the CLARITY Act will be signed into law by December 31, 2026. Kalshi shows a 57% chance that crypto market structure legislation becomes law by October 1, 2027, and a 67.8% probability of a Senate vote before August 8, 2026.

Macro Headwinds

The regulatory optimism collided with deteriorating macroeconomic conditions. Brent crude exceeded $100 per barrel in late July 2026, driven by Middle East tensions including Houthi attacks on Saudi tankers in the Red Sea and U.S.-Iran conflicts. The oil surge pushed market-implied odds of a July Federal Reserve rate hike to approximately 38%, up from around 12% earlier in the month, according to CME FedWatch data.

Crypto assets typically struggle in high-interest-rate environments, as elevated borrowing costs reduce liquidity and risk appetite across speculative markets.

ETF Flows Turn Negative
