FCC-Approved Space Mirror Test Exposes Regulatory Gaps Threatening Night Sky

Reflect Orbital's Eärendil-1 satellite highlights how 1967 space law and outdated environmental reviews leave astronomers and the public vulnerable to commercial expansion.

The night sky is about to get significantly brighter, and there's little the international community can do to stop it.

The Federal Communications Commission approved Reflect Orbital's application to launch Eärendil-1, a test satellite equipped with a 59-by-59-foot space mirror designed to reflect sunlight onto solar farms after dusk. The approval in 2024 signals a new frontier in space industrialization that astronomers warn could transform the darkness of night into something resembling twilight.

A Treaty Built for a Different Era

The legal framework governing space was written in 1967, long before private companies envisioned orbiting data centers or constellations of sun-reflecting mirrors. The Outer Space Treaty establishes that the launching state retains jurisdiction and control over its space objects, meaning the United States alone decides whether to approve satellites registered domestically.

"There is indeed a major challenge right now with single states being able to create large changes to the sky and the orbital environment," said Aaron Boley, an astronomer at the University of British Columbia.

This national prerogative creates a regulatory vacuum. The United Nations requires unanimous consensus for new space regulations, a bar so high that diplomatic progress moves at a glacial pace while commercial deployment accelerates.

Environmental Reviews Bypassed

Perhaps more concerning is what the FCC doesn't have to consider before granting approval. The satellite industry remains exempt from review under the National Environmental Policy Act, relying on a categorical exclusion established in 1986 that has never been reassessed for modern mega-constellations.

The Government Accountability Office has recommended that the FCC reevaluate whether this exclusion remains appropriate given potential environmental impacts across a satellite's lifecycle, from launch through atmospheric reentry. The agency has not yet acted on this recommendation.

Modeling by the European Southern Observatory indicates that if all planned reflective satellite constellations deploy, the overall night sky could become three to four times brighter than current levels. This isn't merely an inconvenience for stargazers.

"This is more than just a niche issue for astronomers. This is an issue that's going to affect the quality of life for everybody on Earth," said Ruskin Hartley, CEO and Executive Director of DarkSky International.

Commercial Interests vs. Global Commons

The conflict pits commercial expansion against preservation of what advocates call a global commons. Beyond astronomical research, a brightened sky affects indigenous cultural heritage tied to celestial observation, confuses nocturnal wildlife, and raises concerns about atmospheric damage from satellite debris during reentry.

"The technology is outpacing the regulatory environment," Hartley said.

The U.S. has a documented history of making unilateral space decisions through the FCC to give domestic industries competitive advantages, often sidestepping international consensus or guidelines from bodies like the International Telecommunication Union. With companies like SpaceX and Blue Origin pursuing orbiting infrastructure, the pressure to approve projects quickly outweighs deliberation about cumulative impacts.

What happens next in Earth's orbit will be decided in Washington boardrooms, not at UN conferences. By the time international law catches up, the night sky may already be irreversibly changed.
