The Social License Gap: Why Regulation Alone Cannot Save Tech Innovation
Legal experts warn that a growing disconnect between legislative speed and public literacy is creating a new barrier to technological adoption.
Rapid technological advancement is outpacing both the ability of governments to regulate it and the public's willingness to trust it. This friction creates a precarious environment where legal permission does not necessarily equal societal acceptance.
During a "Full Crew" newscast hosted by Rex Alexander of Autonomy Global, legal experts Erika Carrasco of MLT Aikins, Courtney Freeman of Adams and Reese, and Chris Senn of Greenberg Traurig analyzed the widening gap between policy and practice. The panel highlighted that while regulators attempt to modernize rules, a lack of public literacy remains a primary obstacle to the deployment of emerging technologies.
The Regulatory Lag
This disconnect is evident across multiple sectors, from artificial intelligence to aviation. In Canada, the "AI for All" strategy currently lacks legal force because binding AI legislation was halted when Parliament ended in 2025, leaving the strategy as a non-binding framework rather than a mandate.
In the United States, the Federal Aviation Administration (FAA) is attempting to modernize a 53-year-old restriction. The agency proposes replacing the 1973 speed-based ban on supersonic flight with a noise-based standard of 0.11 pounds per square foot. This shift toward performance-based regulation faces a significant hurdle: public sensitivity to noise pollution.
Furthermore, the enforcement of "no-drone zones" during the 2026 FIFA World Cup illustrated the tension between security policy and public compliance. Federal agencies logged over 600 drone violations and conducted more than 100 arrests during the event, signaling a gap between the establishment of rules and the public's adherence to them.
The Barrier of Social License
These examples underscore a critical industry challenge: the "social license." This concept suggests that even if a technology is legally permitted by a government agency, public backlash or a fundamental misunderstanding of the tech can still block its implementation. In sectors like AI and aviation, where safety and environmental impacts directly affect residential communities, this barrier is particularly high.
According to Erika Carrasco, governments cannot legislate their way to public confidence if citizens do not understand what the technology actually does. Regulation is a necessary but insufficient condition for success; without a corresponding increase in public literacy, new laws may be viewed with suspicion rather than as safeguards.
The Path Forward
As technology continues to accelerate, the focus must shift from merely writing rules to fostering understanding. Rex Alexander noted that keeping pace with the machines is only half the job, while closing the gap in public understanding is the other half.
Industry observers will be watching whether the FAA's noise-based standards can successfully mitigate public outcry and whether Canada can revive binding AI legislation. The ultimate test will be whether tech leaders and policymakers can move beyond legal compliance to earn a genuine social license from the public.
