Nine PBS Locked Out of 50TB Archive After Storage Provider Goes Silent
A legal battle over 'nested' colocation storage leaves regional historical archives in limbo as a physical host refuses access to a third-party's servers.
Nine PBS is fighting to recover more than 50TB of archival data after its storage provider became unresponsive, leaving critical regional history trapped on servers in a locked facility. The dispute has escalated into a legal standoff between the public broadcaster, a storage middleman, and a physical infrastructure giant.
Despite winning a default judgment in the St. Louis Circuit Court that established its immediate right to possess the data, Nine PBS has been unable to retrieve the files. The data is housed in an Iron Mountain facility in Denver, but the servers are owned and managed by Open Source Storage (OSS). While the court has ruled in favor of the broadcaster, Iron Mountain has refused to grant access to the hardware. An Iron Mountain spokesperson stated that customers rent space for their hardware, which remains the client's asset, adding, "We don’t have access to the data on the hardware/servers because they belong to our customers."
The Colocation Conflict
The impasse stems from the complex nature of colocation and "nested" storage agreements. In this arrangement, Nine PBS contracted with OSS for storage services, while OSS in turn rented physical space and power from Iron Mountain. Because the contractual relationship exists between Iron Mountain and OSS—not the broadcaster—the facility operator maintains that granting a third party access to the servers without a specific court order for the physical hardware would violate privacy protocols and existing contracts.
Nine PBS alleges that leadership at OSS has effectively "ghosted" them, leaving the broadcaster with no way to coordinate the release of the data with the actual owner of the servers. This has left the station in a position where it has a legal right to the data but no physical or digital means of accessing it.
Risks of Data Sovereignty
This case underscores a significant vulnerability in modern data management: the loss of data sovereignty when using middleman service providers. When the physical host and the service provider are separate entities, the client may find themselves without leverage if the provider disappears or becomes unresponsive. The inability to bypass a silent middleman to reach the physical disks demonstrates how technical and contractual layers can obstruct legal judgments.
For Nine PBS, the stakes extend beyond technical frustration. "These archives represent an important part of our region’s history," said Leah Freeman, Nine PBS VP and chief communications officer, noting that the station is seeking to ensure their preservation through the court-approved process.
