G.Skill Settles Misleading RAM Speed Lawsuit for $2.4 Million
The memory manufacturer will pay eligible claimants and update packaging after allegations that advertised speeds required manual BIOS activation.
G.Skill International Enterprise Co., Ltd. has agreed to a $2.4 million settlement to resolve a class-action lawsuit alleging the company misled consumers regarding the speeds of its memory products. The settlement addresses claims that the manufacturer marketed high-performance speeds as standard when they actually required manual user intervention to achieve.
The legal action, Hurd et al. v. G.Skill International (Case No. 2:22-cv-00685), was filed in the U.S. District Court for the Central District of California. According to the lawsuit, G.Skill marketed DDR4 and DDR5 memory speeds that were not "out-of-the-box" defaults. Instead, the advertised performance could only be reached by enabling Intel Extreme Memory Profiles (XMP) or AMD Extended Profiles for Overclocking (EXPO) within the system BIOS. As part of the agreement, eligible claimants can receive cash payments ranging from $20 to $25. The settlement covers desktop DDR4 and DDR5 memory (excluding SODIMM), specifically those with rated speeds exceeding 2133 MHz for DDR4 and 4800 MHz for DDR5.
The Technical Gap
This dispute centers on the difference between industry-standard JEDEC speeds and overclocked profiles. Most high-performance RAM is designed to operate at a baseline speed—such as 2133 MHz for DDR4 or 4800 MHz for DDR5—to ensure system stability during the initial boot process. To reach the higher "rated" speeds listed on the packaging, users must enter the BIOS and activate XMP or EXPO profiles, which essentially apply a factory-tested overclock. While this is a common practice among enthusiasts, the lawsuit alleged that G.Skill failed to clearly disclose that these speeds were not the default state of the hardware.
