China Overhauls Chip Layout-Design Rules to Bolster Tech Independence

China has unveiled a comprehensive revision of its regulations governing the protection of integrated circuit (IC) layout-designs, marking the first major overhaul of these rules since 2001. Signed by Premier Li Qiang, the new framework strengthens intellectual property protections and aligns domestic standards with international treaties.
The revised regulations consist of 54 articles organized across six chapters. According to the official announcement, the rules aim to curb piracy, eliminate fraudulent filings, and clarify ownership and licensing rights. To deter intellectual property theft, the government is introducing punitive damages for serious infringements. The new legal framework is scheduled to take effect on October 15, 2026.

Strengthening legal protections for layout-designs addresses a long-standing gap in the Chinese legal system. Technology industry analyst Ma Jihua noted that IC layout-designs have historically fallen into a "gray area" between patent and copyright protection, which often led to loosely defined rights and difficulties in collecting evidence of infringement. This ambiguity frequently resulted in low compensation and inadequate financial returns for researchers during commercialization.
By reducing this gray area, the institutional upgrade makes it easier for domestic firms to commercialize research and defend assets against piracy. This is critical for China's goal of semiconductor independence, as it provides a necessary legal basis for handling cross-border disputes and protects the massive capital investments required for very-large-scale integration (VLSI) chips.
