A Tesla driver in Parker, Colorado, attempted to avoid a speeding ticket by claiming the vehicle's software was responsible for the violation. The incident underscores the persistent legal and psychological gap between Tesla's automation branding and the actual requirements of the law.

According to the Parker Police Department, the vehicle was clocked traveling 64 mph in a 45 mph zone. When pulled over, the driver told officers, "I wasn’t driving. I had auto assist on," attempting to shift liability to the Full Self-Driving (FSD) system. Police rejected the excuse, stating that driver assistance technology does not replace the driver's legal obligation to operate a vehicle safely, regardless of whether the car uses adaptive cruise control or lane centering.

The Level 2 Reality

Tesla's "Full Self-Driving (Supervised)" is classified as a Level 2 system. Under this designation, the software provides assistance, but the human driver must remain fully attentive and is legally responsible for the vehicle's actions at all times. Despite the "Full Self-Driving" name, the system is not autonomous and requires constant supervision to ensure compliance with traffic laws and safety standards.

Software Shifts and Speed Control

This incident comes as Tesla has fundamentally changed how its vehicles handle speed limits. In the FSD v14 update, Tesla removed the ability for users to set granular, adjustable speed offsets. These were replaced by five fixed presets: Sloth, Chill, Standard, Hurry, and Mad Max.

This design choice reflects a specific philosophy from Tesla's leadership. Ashok Elluswamy, Tesla's head of AI, has described the concept of user-set speed limits or maximum speed controls as an "anti-pattern," suggesting that the system should manage speed based on its own internal logic rather than a user-defined cap.

The Responsibility Gap

The clash in Parker highlights a growing tension as driver assistance systems become more capable. When software manages acceleration and steering, drivers may experience a diminished sense of agency, leading to "automation bias" where they over-rely on the system and ignore their legal duties.

By removing precise speed controls in favor of presets, Tesla has further limited the driver's ability to ensure the car remains strictly within local legal limits. This creates a precarious situation where the software may choose a speed the driver finds acceptable, but which law enforcement deems illegal.
